How do I appeal to the Social Security Tribunal about my EI claim?

We are reviewing this content because of changes to the law. Updated content will be available soon. Read more at the Employment Insurance Board of Appeal of Canada.

The Social Security Tribunal – Employment Insurance Appeal Division (SST – Appeal Division) deals with appeals about Employment Insurance (EI) decisions. You must go through other reviews before appealing to the SST.

What to do first

The first step is to ask for a reconsideration from Service Canada. You can ask for a reconsideration if Service Canada:

  • refused to give you EI benefits, or you think the amount is too low,
  • told you must repay some benefits,
  • gave you a penalty, or
  • gave you a warning letter.

First level of the appeal process

Before April 1, 2026, if you did not agree with Service Canada’s reconsideration decision, the first level appeal was to the Social Security Tribunal – General Division (SST – General Division).

Starting April 1, 2026, this first level of appeal is to the Employment Insurance Board of Appeal (EI BOA).

Any first-level appeals that started before April 1, 2026, will continue at the SST – General Division.

Second level of the appeal process

Second level appeals go to the Social Security Tribunal – Appeal Division (SST – Appeal Division). If you disagree with the first-level appeal decision made by the EI BOA or the SST- General Division, you go to the SST – Appeal Division.

Starting April 1, 2026

In the past, you needed permission to make an appeal to the Appeal Division. You no longer need this.

And the Appeal Division can deal with constitutional questions, which the EI BOA cannot do.

Get legal help

The appeal process can be complicated. It’s a good idea to contact your local community legal clinic for information and advice. They can talk to you about the strength of your case, options, and possible outcomes.
