1. Get your decision and ask for a reconsideration

The Workplace Safety and Insurance Board (WSIB) can take 12 weeks or more to decide about your claim. They must send you their decision in writing.

If they give you their decision over the phone, ask them to send it to you in a letter. This decision letter tells you what benefits, if any, the WSIB decided that you’ll get.

Make sure you understand what the letter says. If you do not understand the letter:

  • ask someone to help you read it, or
  • call the WSIB and ask the person who signed the letter to explain the decision.

Ask for a reconsideration

If you still do not agree with the decision, you can:

  • write to the WSIB employee who made the decision, and
  • ask them to change their decision.

This is called asking for a .

Explain why you disagree. Point out anything important that you think the WSIB employee missed or did not understand.

You can also give the WSIB employee new documents and information that they did not have before.

It usually takes about 14 days to get an answer when you ask for a reconsideration.

Remember to send in your appeal

You do not have to ask for a reconsideration. You can choose just to the decision.

If you decide to ask for a reconsideration, send in your appeal before you do this or at the same time. There's a short deadline to appeal WSIB decisions. It's important not to miss this deadline because you're waiting for the reconsideration.

To start an appeal, you must submit an Intent to Object Form.
