What can I do if I disagree with a WSIB decision?

The Workplace Safety and Insurance Board (WSIB) can make many different types of decisions after you make a claim. For example, WSIB employees can decide how you should return to work or the benefits you can get.

If you disagree with a decision, there are steps you can take:

  • Ask the WSIB employee who made the decision to change their decision.
  • Appeal to the WSIB.
  • Appeal to the Workplace Safety and Insurance Appeals Tribunal (WSIAT).

Ask for a reconsideration

If you have important new information that you think might change the decision,  you can:

  • write to the WSIB employee who made the decision, and
  • ask them to change their decision.

This is called asking for a .

You do not have to take this step. You can choose just to the decision instead.

Appeal the decision to the WSIB

If you disagree with a WSIB employee's decision, you can ask the WSIB to review and change the decision. This is called an appeal or an objection.

You should appeal as soon as possible. If you ask for a reconsideration as well, send in your appeal before or at the same time as you take that step.

To start an appeal, you have to fill out and send in an Intent to Object Form.

Appeal the decision to WSIAT

You might disagree with the decision you get when you appeal to the WSIB. The next step is to appeal the WSIB's final decision to the Workplace Safety and Insurance Appeals Tribunal (WSIAT).

The decision letter from the WSIB should explain how you do this.

To start an appeal to WSIAT, you must submit a form called Notice of Appeal for Workers.
