3. Send in your WSIB appeal on time

How much time you have to send in the Workplace Safety and Insurance Board (WSIB) Intent to object form is different based on the type of decision. The deadline is:

Calendar days are Monday to Sunday.

Your decision letter says how much time you have to  a decision.

The WSIB must get the form before the deadline. Send it in as soon as possible, even if you're waiting for an answer about a . The WSIB is very strict about this deadline.

You can submit documents you're using as with the form or later if you do not have them ready by the deadline.

Send in your Intent to object form

You can fill out and send in the Intent to object form online.

If you fill out a paper form, it's best to fax it with any supporting documents to the WSIB. The fax number is 1-888-313-7373.

You can also mail your form and copies of your documents to:

Send your form as soon as possible after you:

  • get your decision letter, and
  • decide that you disagree with the decision.

If you miss the appeal deadline

You might lose your right to appeal. But the WSIB can extend the deadline to appeal your decision.

Write to the WSIB and explain why your Intent to object form is late.

When deciding if they'll extend the deadline, the WSIB may look at whether:

  • you or a close family member was having serious health problems
  • you had to leave the province or country because someone in your family was very sick or died
  • no one told you about the time limit to appeal

The reasons listed above are just examples. The WSIB can look at other reasons as well. But you need to have a very good reason why you did not appeal the decision on time.
