Can my landlord make me move out for repairs or renovations?
Your landlord might ask you to leave so they can do repairs or renovations. Some work that requires a building permit cannot be done while people are living there.
If so, they must give you a written at least 120 days before the date they need you to move out. The notice should be on a Form N13: Notice to End your Tenancy Because the Landlord Wants to Demolish the Rental Unit, Repair it or Convert it to Another Use from the (LTB).
Losing your home in this way is sometimes called a “renoviction”.
If you get a Form N13, you might be able to:
- challenge the notice if you think there is something wrong with it or that what it says is not true
- move out by giving as little as 10 days' notice
- protect your right to move back in when the work is complete
- have your landlord pay you compensation or offer you another unit
It's always best to get legal advice about eviction problems. You should do this as soon as possible. If you leave this until the last minute, the LTB might not give you extra time to look for help.
