2. Move out by giving 10 days’ notice

You might decide you want to move out either permanently or just until the work is finished. If so, you don't have to wait until the in the your landlord gave you.

After your landlord gives you a Form N13, you can end your and move out on any date. But you must give at least 10 days' written notice to your landlord.

If you want to move back in after the work is done, tell your landlord in writing before you move out. Learn more in Step 3.

If your landlord does not make repairs or renovations

Sometimes landlords are not honest about their plans to repair or renovate a unit. The law calls this “bad faith”.

You can apply to the (LTB) for compensation if:

  • your landlord gave you a Form N13 in bad faith
  • you moved out because you received the Form N13
  • your landlord did not make repairs or renovations within a reasonable time after you moved out

You can apply to the LTB using a Form T5: Landlord Gave a Notice of Termination in Bad Faith. You must apply within one year after the date you moved out.
