5. Learn the different rules for Hamilton, London, and Toronto

In Hamilton, London, and Toronto, your landlord may need to get a renovation licence from the city after they give you a Form N13.

Your landlord may also have to give you more information or pay you more money for making you move out.

If your landlord doesn't follow the rules, you can complain to the city and your landlord could be fined.

But you might not be able to apply to the (LTB). The LTB only deals with laws that apply to all of Ontario. 

Get more compensation in Hamilton or Toronto

If you live in Hamilton or Toronto, your landlord may have to give you even more compensation for making you move out.

The chart below shows the amount your landlord has to pay you if they make you move out for repairs or renovations.

If your landlord does not pay you the right amount, you can complain to the city and your landlord could be fined. But you cannot apply to the LTB for this extra compensation.

Where you live

Ontario, in a building with 5 or more residential units

You landlord must:

  • pay you the amount of your rent for the time it takes to do the work, up to a maximum of 3 months

If your landlord was legally ordered to do the work, for example by the city or by the LTB, they do not have to pay you.

Your landlord must do one of the following:

  • pay you 3 months of rent
  • give you another unit that is acceptable to you

If your landlord was legally ordered to do the work, for example by the city or by the LTB, they do not have to pay you or give you another unit. 

Ontario, in a building with 1-4 residential units

Your landlord must:

  • pay you rent for the time it takes to do the work, up to a maximum of 1 month

If your landlord was legally ordered to do the work, for example by the city or by the LTB, they do not have to pay you.

Your landlord must do one of the following:

  • pay you 1 month of rent
  • give you another unit that is acceptable to you

If your landlord was legally ordered to do the work, for example by the city or by the LTB, they do not have to pay you or give you another unit. 

Hamilton

Your landlord must follow the rules for Ontario.

If your landlord gave you a Form N13 on or after January 1, 2025, they must also do one of the following:

  • give you a temporary place to live while the work is being done
  • pay you the difference between your current rent and the average rent in Hamilton while the work is being done

If you and your landlord do not agree on which of these things will happen, the city can give the landlord permission to give you nothing at all.

Toronto

Your landlord must follow the rules for Ontario.

If your landlord gave you a Form N13 on or after July 31, 2025, they must also:

  • pay moving expenses of:
    • $1,500 for a studio or one-bedroom unit
    • $2,500 for a unit with 2 or more bedrooms
  •  do one of the following:
    • give you temporary housing while the work is being done, or
    • pay you the difference between your current rent and the average rent in your area while the work is being done

If your landlord offers you temporary housing, you do not have to accept it. If you do not accept, your landlord must pay you the difference between your current rent and the average rent in your area while the work is being done.

Your landlord must follow the rules for Ontario.

If your landlord gave you a Form N13 on or after July 31, 2025, they must also:

  • pay moving expenses of:
    • $1,500 for a studio or one-bedroom unit
    • $2,500 for a unit with 2 or more bedrooms
  • pay you the difference between your current rent and the average rent in your area for 3 months
