1. Fill out the Notice of Appeal form

You file or send your Notice of Appeal form to the Employment Insurance Board of Appeal (EI BOA).

In your , you're the appellant because you made the appeal. The respondent is the person defending the decision you disagree with.

You must do this within 30 calendar days from the date Service Canada told you their decision. The 30 days include weekends and holidays and begin the day after you found out about the reconsideration decision.

If you submit your Notice of Appeal after the 30-day deadline, you must give a reasonable explanation for the delay. The EI BOA does not say what it means by “reasonable”.

But the EI BOA will not accept your Notice of Appeal if it's more than one year after you were told about the reconsideration decision.

To file your appeal

You need:

  • your Service Canada Record ID number, which is on the reconsideration decision letter
  • your personal information, including (SIN)
  • the date on the reconsideration decision letter
  • the date you were told about the reconsideration decision

To appeal to the EI BOA

You need to:

  • fill out the Notice of Appeal form on paper or online
  • make sure you complete all the required sections
  • sign and date the form make a copy for your records

Gather your documents and evidence, which could include:

  • pay stubs
  • your or other employment records
  • your or employment contract
  • a medical or specialist's report
  • bank statements
  • job search records
  • settlement agreements
