1. Learn when you can apply for a TRP
You're not eligible to apply for a (TRP) if:
- It's been less than a year since there was a final decision about your refugee claim and it was:
- rejected,
- abandoned, or
- withdrawn after was given at your hearing.
- You're not eligible to apply for refugee protection and are waiting for a decision on a .
- You're a .
You may be eligible for a TRP in Canada if:
- you're or do not meet a legal requirement that you need to stay in Canada,
- you broke Canadian immigration rules in the past, or
- you're not eligible to renew the status that you have in Canada.
Inadmissible to Canada
You may not be able to stay in Canada if you're inadmissible for criminal, financial, or medical reasons.
Talk to a lawyer about the reasons why you're inadmissible to Canada and to find out if you're eligible for a TRP.
Not following Canadian immigration rules
You may not be able to stay in Canada if:
- you broke Canada's immigration rules or laws in the past,
- you did not meet a legal requirement that you need to stay in Canada, or
- you're not eligible to renew the status that you have in Canada.
This means that you might get a that says you must leave Canada.
For example, you may get a removal order if:
- you lied on a past immigration application, which is called misrepresentation
- you used false documents
- you stayed in Canada longer than you were supposed to

Reasons why you could get a TRP
If you're eligible for a TRP, your reasons for staying must be compelling enough for you to get a TRP.
Immigration, Refugees and Citizenship Canada (IRCC) weighs your reasons for wanting to stay against the fact that you:
- are inadmissible, or
- pose a risk to Canada if you stay.
