4. Appeal the reconsideration decision

There are 2 levels to the process.

First level of appeal

Starting April 1, 2026, if you disagree with the decision from Service Canada, you can appeal to the Employment Insurance Board of Appeal (EI BOA).

The Social Security Tribunal – General Division (SST – General Division) will continue to deal with EI reconsideration appeals made before April 1, 2026.

You cannot appeal to the EI BOA until you have finished the reconsideration process with Service Canada.

Second level of appeal

If you disagree with the decision of the EI BOA or the SST – General Division, you can go to the second level of appeal. You do this with the Social Security Tribunal of Canada – Appeal Division (SST – Appeal Division).

Constitutional appeals

The EI BOA cannot consider any questions about constitutional law. You can appeal an EI BOA decision to the SST – Appeal Division if they did not decide about a constitutional law question.
